These terms and conditions shall govern the sale and purchase of products through blackandcoral.com.
You will be asked to give your express agreement to these terms and conditions before you place an order on blackandcoral.com.
This document does not affect any statutory rights you may have as a consumer (such as rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015).
INTERPRETATIONIn these terms and conditions:

The advertising of products on our website constitutes an "invitation to treat" rather than a contractual offer.

The following types of products are or may be available on our website from time to time: Jewelry and accessories.
- Materials: Swarovski® and Bohemia Crystals (Czech Republic). [18 k Yellow / Rose Gold plated] 925 Sterling Silver. Gold plated Brass. Italian Suede. Nylon, rayon, cotton, silk and polyester yarns. Zirconias. Pearls. Corals. Semi-precious stones.
All materials are acquired in the European Union.
The metal parts are acquired in the European Union of suppliers that certify the plated and galvanized nickel free.
All the materials are non-toxic, nickel free, perfectly compatible with the directives of the European Union 2001/95 and 94/27/CE and conform to the European regulation N. 1907/2006 (REACH).
We may periodically change the products available on our website, and we do not undertake to continue to supply any particular product or type of product.
The color and the measurements of the products may vary minimally according to the products that we show in the images because they are handmade products. Each piece is unique.
Our prices are quoted on our website.
We will from time to time change the prices quoted on our website, but this will not affect contracts that have previously come into force.
All amounts stated in these terms and conditions or on our website are stated [inclusive of VAT] OR [exclusive of VAT].
It is possible that prices on the website may be incorrectly quoted; accordingly, we will verify prices as part of our sale procedures so that the correct price will be notified to you before the contract comes into force.

You must, during the checkout process, pay the prices of the products you order.

If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay us, within [7 days] following the date of our written request:
an amount equal to the amount of the charge-back;
all third party expenses incurred by us in relation to the charge-back (including charges made by our or your bank or payment processor or card issuer);

all our reasonable costs, losses and expenses incurred in recovering the amounts referred to in this Section 6.4 (including without limitation legal fees and debt collection fees), and for the avoidance of doubt, if you fail to recognize or fail to remember the source of an entry on your card statement or other financial statement, and make a charge-back as a result, this will constitute an unjustified charge-back for the purposes of this Section.

VALUE ADDED TAX (VAT)
In accordance with current regulations, all purchases made through the Website will be subject to Value Added Tax (VAT), which will be charged at the rate in force at the time of delivery.
SHIPPING AND EXCHANGES
Our policies and procedures relating to the delivery and Exchanges of products are set out in our Shipping and Exchanges section that we recommend you to visit it.
We will arrange for the products you purchase to be delivered to the delivery address you specify during the checkout process.
We will use reasonable endeavors to deliver your products on or before the date for delivery set out in the order confirmation or, if no date is set out in the order confirmation, within 7 days following the date of the order confirmation; however, we do not guarantee delivery by this date.
We do guarantee that unless there are exceptional circumstances all deliveries of products will be dispatched within 30 days following the later of receipt of payment and the date of the order confirmation.
We will only deliver products [to addresses on the UE] at the moment.
ATTENTION: Due to safety and hygiene reasons, we cannot accept changes or returns on earrings and necklaces. No refund. We have two exceptional cases specified in the section: Warranty Service.
Some of our Black and Coral jewels have a 6 month warranty service from the date of purchase.
- Customer must notify by email sent to firstname.lastname@example.org indicating the object [Product Warranty] the order number, and the product.
- The product must be sent assuming Black and Coral shipping costs. You must ask Black and Coral to pick up the product package within 14 days of receiving the item and with its original jewelry case protected to Black and Coral (C / Orense 29, 28020, Madrid). You must agree with the company to request a date. In case the package is not in perfect condition because the client has not taken the measures of protection of the it, the client will be notified by Black and Coral and the company will not be responsible for the expenses of the new shipment to the client. Formalized the process will proceed to change/repair the product.
Black and Coral is not responsible for:
REPAIR AND MAINTENANCE JEWELRY SERVICE
Our repair and maintenance jewelry service will be valued for each piece by means of an estimate individually specific to each case.
Customer must notify by email sent to email@example.com indicating the object [Repairs and Maintenance Service], the order number and the product. You must specify the damage to be repaired and a photo of the jewel (if possible). In approximately 1-2 days Black and Coral will contact you to proceed with the repair of the product, by making an initial budget (which can be modified by carefully evaluating the piece by expert hands in our atelier).
The product must be sent assuming customer shipping costs with its original jewelry case protected to Black and Coral (C / Orense 29, 28020, Madrid). In case the package is not in perfect condition because the client has not taken the measures of protection of the same, the client will be notified by Black and Coral and the company will not be responsible for the expenses of the new shipment to the client. Formalized the process will proceed to repair the product.
For pieces that have less than 14 days since customer received the product, the repair and shipping costs will be free for the client.
Black and Coral is not responsible for:
lost or not received packets that have been sent by customer for repair.
pieces that have been damaged by customer due to incorrect use and/or improper preservation of the jewelry. Learn how to take care of your jewelry with some basic tips [next paragraph].
JEWELRY CARE RECOMMENDATIONS
Each Black and Coral jewel is precious and unique. Taking care of them will help you keep them in perfect condition over time and maintain the brightness, following some basic tips:
Our jewels are delicate pieces, so we recommend you to handle them with care.
Jewelry should be cleaned gently regularly with a suede cloth.
It is best to avoid contact with water. Take them off carefully before showering. Do not bathe in the pool with them on or take them to the beach. In these three cases, not only water can damage your jewelry, but also soap, chlorine and sea saltpetre, sand and prolonged intense sun exposure or sources of intense heat.
Avoid direct contact with perfumes, cosmetics and abrasive products (such as household cleaning, DIY and gardening).
We suggest you take off the pieces before doing certain physical activities such as sports or cooking. Apart from the aforementioned external agents, sweat and the Ph of the skin itself can alter the brightness of your pieces. It is recommended that you also take them off before going to sleep.
Jewelry can be scratched if they are in contact with each other without proper protection. We advise you to keep them individually in their original case. But also an optimal form of preservation is in an airtight jeweller with padded interior. Chains necklaces must be closed and placed flat to prevent knots from forming.
It is not advisable to leave and/or keep your jewelry in the bathroom. Contact with water moisture can alter them and make them lose their original shine more easily.
Black and Coral is not responsible for pieces that have been damaged due to incorrect use and/or improper preservation of the jewelry.
INDUSTRIAL AND INTELLECTUAL PROPERTY
AVAILABILITY OF THE ONLINE PURCHASE SERVICE
The Service will be available permanently twenty-four hours a day. Black and Coral informs the buyer that there may be anomalies or interruptions in the availability or operation of the Service due to causes not attributable to Black and Coral (technical problems of Internet providers, telecommunications, problems in the buyer's terminal, etc.), so the period to make the purchase may be extended.
WARRANTIES AND REPRESENTATIONS
You warrant and represent to us that:
you are legally capable of entering into binding contracts;
you have full authority, power and capacity to agree to these terms and conditions;
all the information that you provide to us in connection with your order is true, accurate, complete and non-misleading; and
you will be able to take delivery of the products in accordance with these terms and conditions[ and our shipping and exchanges policy].
We warrant to you that:
we have the right to sell the products that you buy;
the products we sell to you are sold free from any charge or encumbrance, except as specified in these terms and conditions;

the products you buy will be of satisfactory quality.
All of our warranties and representations relating to the supply of products are set out in these terms and conditions. To the maximum extent permitted by applicable law and subject to Section Limitations and exclusions of liability paragraph 1, all other warranties and representations are expressly excluded.
LIMITATIONS AND EXCLUSIONS OF LIABILITY
Nothing in these terms and conditions will:
limit or exclude any liability for death or personal injury resulting from negligence;
limit or exclude any liability for fraud or fraudulent misrepresentation;
limit any liabilities in any way that is not permitted under applicable law; or
exclude any liabilities that may not be excluded under applicable law, and, if you are a consumer, your statutory rights will not be excluded or limited by these terms and conditions, except to the extent permitted by law.
The limitations and exclusions of liability set out in this Section and elsewhere in these terms and conditions:
are subject to Section Limitations and exclusions of liability paragraph 1; and
govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions.
We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.you agree that you will not bring any claim personally against our officers or employees in respect of any losses you suffer in connection with the website or these terms and conditions.Our aggregate liability to you in respect of any contract to purchase products from us under these terms and conditions shall not exceed the greater of:
